This document governs the General Terms and Conditions of Sale (the “General Conditions”) relating to orders, product purchases and information sharing between GIANLUCA VIETRI ART, based in Via Sant’Eremita, 27, Salerno, P .IVA 01314911007 (“GIANLUCA VIETRI ART” or “we” hereinafter) and the customer (“You” or “Your”) who intends to order and purchase products through the Italian section of the website gianlucavietriart.com (the “Site”) .

To place orders on the Site, you must be of legal age and have legal capacity. You can place the order through the Site and pay the price of the chosen product / s, following the instructions on the Site. Once the order has been placed (by clicking on the “submit order” button), GIANLUCA VIETRI ART will confirm receipt by sending an automatic message (the “Confirmation of receipt”). This acknowledgment of receipt does not represent acceptance on our part. Each order, in fact, is subject to express acceptance by GIANLUCA VIETRI ART which reserves the right to cancel an order even after sending the confirmation of receipt.

To place an order, you must select the products you wish to purchase and click on “Add to cart”. The selected products will then be added to the “cart” and the order can be concluded by filling in the appropriate form and accepting the General Conditions of Sale as indicated on the Site. Before concluding the order, you must check the accuracy of the information provided and correct any inaccuracies. The order will be sent by clicking on the “submit order” button. Sending the order by clicking on the “submit order” button does not imply acceptance of the order and conclusion of the purchase. In fact, your order constitutes a purchase offer to GIANLUCA VIETRI ART. Once sent, the order will be taken over by us. The acceptance of the order by GIANLUCA VIETRI ART will be confirmed by sending an email (the “Order Confirmation”).

You can cancel an order at any time until the order confirmation is sent by GIANLUCA VIETRI ART. Once accepted by GIANLUCA VIETRI ART through the Order Confirmation, the order can no longer be modified or canceled, unless otherwise provided for by these General Conditions or by law. GIANLUCA VIETRI ART also reserves the right to verbally confirm orders.    2. has not paid for the products purchased at the expiry of the deadline;
   3. is involved in fraudulent or gray market activities (i.e. resale of products through channels not belonging to the sales network authorized by GIANLUCA VIETRI ART or its affiliates);
   4. refuses to provide information that GIANLUCA VIETRI ART is required to collect by law;

4. GIANLUCA VIETRI ART has the right to cancel an order under these General Conditions.

In the event that GIANLUCA VIETRI ART cancels an order, it will refund any payment previously made. GIANLUCA VIETRI ART does everything possible to ensure that the color, design and style of the products depicted on the Site are representative of the original products at their best. Despite this, the appearance of the original product may differ slightly from what is depicted on the Site for technical or other reasons. Some products identified on the website may be available for pre-order. Subject to the conditions set out in this document and the conditions mentioned on the web page of the products available for pre-order (delivery period and delivery options), pre-orders will be governed by the same processes and conditions applicable to standard orders. In the case of a mixed order consisting of currently available products and pre-ordered products or in the case of a pre-order of multiple products with different delivery dates mentioned on the website, the most recent delivery date will apply to the entire pre-order. At the time of pre-order, GIANLUCA VIETRI ART will obtain a credit authorization from the issuer of your card equal to the full amount of the purchase. The prices of GIANLUCA VIETRI ART products are indicated in Euros and include all applicable taxes. Shipping costs are excluded and surcharges are applied when choosing to insure the content of the shipment.
GIANLUCA VIETRI ART reserves the right to change the price of the products displayed on the Site at any time and without prior notice. You will be charged the price displayed on the Site when the order was sent by you by clicking on the “submit order” button. You will also be responsible for the costs incurred in using the remote means of communication used to send the order (such as the telephone rate and internet connection).
For each order placed through the Site, you will have to make the payment at the time the order is placed. The amount of products ordered will be blocked on your account but will only be charged at the time of the confirmation of the order by Gianluca Vietri ART.

Payments by credit card issued by the following institutions are accepted: Visa, Amex, Mastercard. All orders must be paid for in Euros. The order must contain an Italian delivery address. It will not be possible to place orders with a non-Italian delivery address.

The product will remain the property of GIANLUCA VIETRI ART until the full amount has been paid. The ordered products will remain under the responsibility of GIANLUCA VIETRI ART until signed and received by you. Once you have received the products, you accept and assume all risks relating to the products (including loss, theft or damage).

The pre-order service allows you to preview a product that is part of a new collection or a limited edition, before it is available for sale on the official website and in GIANLUCA VIETRI stores. ART. If a product is available for pre-order, the product page will expressly indicate that it is a “PRE-ORDER” product. This means that the product is not immediately available in our warehouse and will be shipped to you as soon as it is available. The standard delivery times indicated on the Site will apply from the moment the booked product has been shipped; it is advisable to check the estimated shipping date at the checkout stage. Unless otherwise indicated, pre-orders are subject to the same terms and conditions as orders placed through the Site, as provided for in these General Conditions.

Products purchased through the Site can only be delivered within the Italian territory. The products will be shipped to the address you entered during the ordering process and indicated in the order confirmation. Only one address can be entered for each order.
P.O.Boxes cannot be used for the delivery of our products. If you enter the address of a Hotel as the delivery address of the order, the delivery can only be made to the person indicated in the order and to no one else, including the hotel reception. Your signature is required upon delivery.
The products will be shipped in a single package that includes the product, packaging, payment receipt or invoice where required, and, depending on the case, the jewelry certification and warranty certificate.
To receive the package, the signature of an adult is required.

Except for products purchased in pre-order, orders will be delivered by standard delivery within 2-4 working days from the date of order confirmation, except in exceptional cases that are beyond the control of GIANLUCA VIETRI ART and for which You will be contacted immediately.

For pre-order products, it must refer to the estimated shipping date as indicated on the product description page.
The delivery of products purchased through the Site is free.

Any non-deliveries or deliveries occurring more than seven (7) days from the date of shipment (ten (10) for deliveries to the islands), must be reported to our customer service as soon as possible. Any complaint must be communicated within a maximum of fifteen (15) days from the date of confirmation of your order. Once the order has been received, you will have to check the products. If the products received do not comply with the order you placed, or you are not satisfied, you must immediately contact the concierge service by contacting customer service and request a return or replacement in accordance with the Return Policy.

a) General rules

To return a product purchased through the Site, and obtain a refund of the price paid or request a replacement with another product, you can return the product, without scratches or dents, by contacting our customer service or our office.
All returns must contain the original sales receipt and be returned in the original packaging. The right of withdrawal is excluded for customized products, which cannot therefore be returned, refunded or replaced.

All products returned following a return or replacement request are subject to a quality control before being accepted. Products with signs of wear, damage or alteration (including changes in size) or whose label, where present, has been removed, will not be accepted. You will be refunded the price of the products whose return has been accepted by GIANLUCA VIETRI ART. However, you will be responsible for any decrease in value of the returned products due to unsuitable use to preserve the nature, characteristics and, where applicable, the functioning of the products.

Our Return Policy does not intend in any way to exclude or limit the rights or mandatory remedies that you are entitled to under the law.

b) Return via customer service

Once the communication relating to your wish to withdraw from the contract has been received, GIANLUCA VIETRI ART will activate the return procedure. You can return the products by sending them directly to GIANLUCA VIETRI ART via Sant’Eremita 27, 84125 Salerno, together with the Return Form or other declaration of your will to withdraw from the contract. You must return the product within 14 days from the time of purchase with your communication to GIANLUCA VIETRI ART of the will to withdraw. The aforementioned deadline is met if the shipment of the product is made before the expiry of the 14 days. The refund of the returned product will be made on the same payment method used for the purchase on the Site. If you have replaced the product with another of a higher value, you will be charged the difference. It will not be possible to replace a product with another of a lower value. In the case of gifts, the recipient of the gift can only request the replacement of the product given with another of equal or greater value. In case of replacement of an incorrect product or one that has manufacturing defects, the shipping costs, if paid, will be refunded.

c) Return to a GIANLUCA VIETRI boutique ART

GIANLUCA VIETRI ART also offers you the possibility to return a product purchased through the Site for a replacement at one of the following GIANLUCA VIETRI ART boutiques in Italy.

In addition to the legal guarantee guaranteed to consumers and applicable to products purchased through the Site, which cannot be excluded or modified, the following guarantee is provided in relation to works of art. Double certification of the Work.

APPLICABLE LAW

These General Conditions, their interpretation and execution, including transactions made through the Site, are governed by the laws of the Italian Republic. Each party irrevocably undertakes to submit to the jurisdiction of the courts of the Italian Republic in relation to any claim or any other matter concerning these General Conditions.

GIANLUCA VIETRI ART may modify, suspend or interrupt the functioning of the Site at any time. We reserve the right to limit, suspend or terminate your access to the Site and / or its services, if we have reason to believe that you are in breach of these General Conditions or applicable laws, or for any other reason, without prior notice or responsibility on our part. We may prevent the use of the Site in the event of repeated violations of intellectual property rights.

Failure by us to exercise any right or provision of these General Conditions does not constitute a waiver of such right or provision. If a clause of these General Conditions is considered in whole or in part null or ineffective, such nullity or ineffectiveness will not extend to other clauses of these General Conditions which will remain fully effective.

The order confirmation and these General Conditions constitute the entire agreement between you and GIANLUCA VIETRI ART with reference to the subject of the same.

All trademarks, logos or service marks (the “Brands”) appearing on the Site, whether registered or not, are the exclusive property of GIANLUCA VIETRI ART and / or its subsidiaries / affiliates. These General Conditions and all materials, elements and contents (including drawings, models, illustrations, photographs, videos, texts, codes, audio and graphic tracks) included in the Site, are the exclusive property of GIANLUCA VIETRI ART and / or its subsidiaries / affiliates. Nothing contained on the Site can in any way be interpreted as an implied license of any kind or right to use the Trademarks displayed on the Site itself, without the written authorization of GIANLUCA VIETRI ART. Unless we give you specific written authorization in advance, any other use of the Site, its contents and information is strictly prohibited.
